Terms of use

Welcome to fyngoods (hereinafter referred to as "we") cross-border fashion e-commerce services. These Terms of Use (hereinafter referred to as "Terms") constitute a legal agreement between you (user/buyer) and us regarding the use of the fyngoods website, purchase of products and related services. Please read these Terms carefully. By accessing, browsing, registering, placing orders or using our services in any way, you are deemed to have fully understood and agreed to all the contents of these Terms and accepted the binding of these Terms. If you do not agree to these Terms, please do not use any of our services.

1. User Eligibility and Registration

1.1 User Eligibility

You represent and warrant that you are at least 16 years old and have full capacity for civil conduct (if you are under 16 years old, you must use this service with the consent and supervision of your legal guardian), and that you are the legitimate owner and user of the identity information, contact information, payment account and other relevant materials you provide. You promise that all information provided is true, accurate, complete and valid, and if the information changes, you shall update it in a timely manner.

1.2 Account Management

After registering a fyngoods account, you shall properly keep the login information such as the account user name and password, and bear full responsibility for all operations under the account (including placing orders, making payments, modifying information, etc.). If you find that your account has been illegally stolen or fraudulently used, you shall immediately notify us. We will take necessary measures such as suspending the account and changing the password after verification, but we shall not be liable for any losses caused by your improper custody. You shall not rent, lend or transfer your account to a third party for use, otherwise you shall bear all responsibilities arising therefrom.

2. Products and Orders

2.1 Product Information

We will truthfully display the product name, specification, material, price, inventory, origin and other information on the website, and make every effort to ensure the authenticity, accuracy and completeness of the information. However, due to force majeure factors such as clothing style updates, inventory changes, and supplier adjustments, temporary information deviations may occur. We reserve the right to modify and update product information, and shall not be liable for any indirect losses caused to you thereby. You should carefully check the product information before placing an order, and contact customer service for confirmation if you have any questions.

2.2 Order Establishment and Performance

After you place an order on the website and complete the payment, the order is established, and a sales contract relationship is formed between both parties. We will perform the delivery obligation in accordance with these Terms and the "Shipping & Delivery Information" published on the website (default delivery within 48 hours, and no later than 72 hours, except during public holidays and sample production periods, subject to the website announcement). If you find that the order information (shipping address, contact information, product specifications, etc.) is incorrect after placing the order, you should contact us to modify it in a timely manner before the order is shipped. If the order has been shipped, we will not be able to modify it, and you shall bear all losses arising therefrom.

2.3 Order Cancellation and Refund

Before the order is shipped, you can apply to cancel the order. If the product has not been delivered from the warehouse, we will fully refund the payment you have made; if the product has been delivered from the warehouse, you need to bear the corresponding warehouse delivery, packaging and other costs before we process the refund. After the order is shipped, you shall not arbitrarily cancel the order or apply for a refund except for our responsibilities such as product quality problems and wrong delivery. The refund will be returned to the original payment method, and the arrival time is subject to the processing time of the payment platform or bank.

3. Product Quality and After-Sales Service

3.1 Product Quality

We guarantee that all products sold on the website meet the relevant quality standards and are consistent with the product information displayed. If the product has quality problems (such as damage, deformation, inconsistent material with the description) after you receive it, you can contact us within 7 days of receiving the goods to apply for after-sales service (return, exchange or refund), and you need to provide relevant proof (such as photos, videos) to verify the problem.

3.2 After-Sales Scope

After-sales service is not provided for the following situations: (1) Damage caused by improper use, storage or manual damage by you; (2) Normal wear and tear of the product during use; (3) The product is modified, disassembled or repaired by a third party without our consent; (4) No relevant proof of quality problems is provided; (5) The after-sales application exceeds the specified time limit.

4. User Obligations

When using our services, you shall abide by national laws, regulations and these Terms, and shall not engage in any illegal or improper behavior, including but not limited to: (1) Using the website to publish illegal, obscene, defamatory, infringing or other inappropriate information; (2) Stealing, tampering with or damaging the website data, programs or other information of us or third parties; (3) Using the website to engage in fraud, money laundering and other illegal activities; (4) Violating the intellectual property rights of us or third parties (including but not limited to trademarks, copyrights, patents); (5) Other behaviors that violate laws, regulations or these Terms. If you violate the above obligations and cause losses to us or third parties, you shall bear full compensation responsibility.

5. Our Rights and Obligations

5.1 Our Rights

We have the right to supervise, review and manage your use of the service. If we find that you violate these Terms or engage in illegal activities, we have the right to take measures such as warning, suspending account rights, terminating account, and refusing to provide services, and reserve the right to pursue your legal responsibility. We have the right to adjust the service content, product price, rules and regulations according to the needs of business operation, and will notify you through the website announcement or other appropriate ways. Your continued use of the service after the adjustment constitutes your acceptance of the adjusted content.

5.2 Our Obligations

We shall provide stable and safe services in accordance with the agreement of these Terms, and do our best to protect the legitimate rights and interests of users. We shall properly keep the personal information provided by you in accordance with the Privacy Policy, and shall not disclose, sell or illegally use your personal information without your consent (except as required by law).

6. Intellectual Property Rights

All intellectual property rights (including but not limited to trademarks, copyrights, patents, trade secrets) of the fyngoods website, logo, product pictures, text content, program code and other related materials belong to us. You shall not use, copy, modify, spread or transfer the above intellectual property rights without our written permission, otherwise you shall bear the corresponding legal responsibility.

7. Limitation of Liability

We shall not be liable for any indirect, incidental, special or consequential losses caused by the following situations: (1) Force majeure (including but not limited to natural disasters, wars, government orders, network failures); (2) Your improper use of the service or your own fault; (3) Information provided by third parties or services provided by third parties; (4) Temporary service interruption or failure caused by technical upgrades, maintenance and other necessary operations. Our total liability for any direct loss caused by our fault shall not exceed the total amount of the order corresponding to the loss.

8. Termination of Service

You may terminate the use of our services at any time by canceling your account. We have the right to terminate the service provided to you immediately if: (1) You violate these Terms and fail to correct it within the time limit we notify; (2) Your account is inactive for a long time (more than 12 months); (3) We terminate the service due to business adjustment or other reasons. After the termination of the service, we will no longer provide you with relevant services, but we will still keep your personal information in accordance with the Privacy Policy and relevant laws.

9. Changes and Interpretation of Terms

We may update these Terms from time to time according to changes in laws, regulations and business needs. The updated Terms will be published on the website with a revised effective date. Your continued use of the service after the update constitutes your acceptance of the revised Terms. 10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any dispute arising from or in connection with these Terms shall first be resolved through friendly negotiation between both parties; if the negotiation fails, either party may file a lawsuit with the people's court where our company is located.
